TERMS & CONDITIONS OF BUSINESS
Third party liability. Every person on Waterman’s Auction Rooms premises at any time shall be deemed to be there at his or her own risk. He or she shall have no claim against Waterman’s Auction Rooms in respect of any accident which may occur, or injury, damage or loss howsoever caused , save insofar any injury, damage or loss shall be caused by the direct negligence of Waterman’s Auction Rooms employee’s. STANDARD CONDITIONS OF SALE
Waterman’s Auction Rooms does not accept responsibility for the authenticity, attributes, genuineness, origin, authorship, date, age, period, condition or quality of any lot, unless they have instructed in writing by the vendors so to certify and in such case the Auctioneers do so as agents to the vendor and are not, themselves, responsible for such claims.
The Auctioneer has absolute discretion to divide any lot, to combine any two or more lots or to withdraw any lot or lots from the auction, to refuse bids, regulate bidding or cancel the auction without, in any case, giving any reason or without previous notice. He may bid on behalf of the vendor for all goods which are being offered subject to reserve, or at the Auctioneers discretion
THE SELLER
The Auctioneer sells as an agent for the seller and as such is not responsible for any default or the seller or buyer
All goods / articles are left entirely at the owners risk. Waterman’s Auction Rooms or any of it’s staff shall not be held responsible for any goods / articles received or stored by us.
Any insurance requirements are a matter for the owner, whilst are not insured
We reserve the right to be selective and to refuse any goods / articles without reason
If the goods / articles fail to reach their reserve price they shall be removed by the vendor. Unsold goods / articles may be entered in the next sale, however, this will be at a lower reserve price. Goods / articles entered for a third sale must be entered with no reserve price. Goods / articles remaining unsold after three auction entries are to be removed by the vendor.
All sold / unsold lots (excluding those to be entered again) must be removed by close of business on the Tuesday following the auction. After this a storage charge of £5 per lot per day will be charged. Goods not removed within three weeks will be auctioned without a reserve price and any storage charge deducted accordingly.
Goods / articles are only accepted on the basis that they will not be offered for sale elsewhere while they are on the premises. A signature on this form acknowledges this fact. Commission of 20% of the hammer price is payable on all goods / articles sold whilst on these premises.
The description of goods / articles in the catalogue will be that of the vendor, not the sale rooms. No lots shall be removed from the auction within the 48 hours prior to the auction commencing. Any lot removed in this time shall be subject to a fee of 20% of the guide price given by the Auction. A venders premium of 20% will be payable on all lots
THE BUYER
The highest bidder shall be purchases. If any dispute arises between the bidders or any mistake be made, the lot will be put up again immediately preceding the dispute, or the Auctioneer may declare the purchases
The advance in the bidding to be regulated by the Auctioneer, who is to be the sole arbiter to the matter of dispute or mistake. He also reserves to himself the right to refuse any bidding, to bid on behalf of the vendor in the case of goods / articles (if any) upon which there is a reserve, to withdraw, consolidate or divide any lot of lots to submit the lots in any order, without regard to the position of the same in the catalogue, as may be deemed advisable
Each and every lot shall, at the fall of the hammer, be considered as delivered, and no lot or lots can be removed until the whole amount of the purchaser’s account shall be paid in full. No warranty is given, or to be implied by the description in the catalogue and no guarantee is given with any picture, print or drawing. The lots having been on view are sold with all faults, imperfections and errors of description
All lots must be paid for and cleared away from the premises at the purchasers expense and risk, not later than 12pm on the Tuesday following the sale, unless prior arrangements have been made, in default of which the auctioneers will not hold themselves in any way responsible if the lost be lost, stolen, damaged or destroyed and they will remain at the sole risk of the purchaser.
Any damage caused by removal, or otherwise, must be made good by the person committing the same, principles being considered responsible for the acts of their servants, such damage to be assessed by the Auctioneers.
The Auctioneers reserve the right of making an allowance for the whole or any portion of a lot not delivered from any cause whatever, at the same rate at which such lot was purchased; and in as much as the auctioneers act only as agents for the vendor, they shall not be considered personally responsible for any default on the part of either the vendor or the purchaser.
Any lots not cleared by the appointed time, agreeably with the conditions, will be fortified, and may be re sold or warehoused at the expense of the purchaser; any deficiency arising from re sale, together with warehouse charges, and all attendant expenses, shall be made good by the purchaser.
A buyers premium of 20% will be payable on all lots

The acceptance of all the above conditions as terms of the contract of sale is and is to be a term of and / or condition precedent to the bidding for any of the lots and received delivery if the said goods so auctioned and / or sold.
